Insurance fraud is a voluntary act that makes it possible to derive an illegitimate profit from an insurance contract. It constitutes, on a legal level, a criminal offense characterised as fraud or attempted fraud.
It is necessary to distinguish two general forms of fraud:
- Fraud when taking out the policy
- Fraud when making a claim
In the case of car theft or arson, whilst not necessarily fraudulent, there is certainly a criminal act.
